After receiving the SSDI Review, the SSA will decide whether to approve, defer, or remand. It then sends a memorandum to the MDH Unit informing it whether the data-related arrangement is approved, denied, deferred, and remanded. The MDH unit can proceed with execution if the agreement is approved.
If an application has been denied, the SSA will issue a second notice. The applicant who was denied has sixty-five business days from the date to request a hearing in front of an Administrative Law Judge (ALJ). This hearing is similar in format to the one on disability. It can be held in person, over the phone, or via videoconference. During the hearing, the applicant or his or her representative can bring witnesses to testify about the issues and the circumstances surrounding the denial. The ALJ may also arrange for expert testimony to support the case. If the applicant loses, then the ALJ will write to the applicant stating the reasons. The hearing could take many months.
A disability review can take between three and seven years. The review can be denied, approved, or remanded to the SSA for further information. The SSA could also conduct a disability assessment if the individual is able to work again after undergoing medical improvement.
